Terms of Service
Welcome to Dank Memes Only ("Dank Memes Only", "we", "us", "our"), a subscription service that delivers a daily, hand-picked selection of memes at dankmemesonly.com (the "Service"). The Service is operated by Akash Wadhwani (Sheets.Works). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Eligibility
The Service contains adult humor, profanity, and occasional mature content. You must be at least 18 years old to use it. By using the Service you represent that you are 18 or older and able to form a binding contract.
2. The Service
Non-members may view a limited number of free memes per day. Members receive a larger daily selection (currently up to 100 memes per day) with no ads. The number of free and member memes, and the content of any given day's selection, may change at any time. We do not guarantee that any particular meme will be available.
3. Your account
You need an account to subscribe. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at akash@sheets.works if you suspect unauthorized use. One person per account; do not share accounts.
4. Subscriptions, billing, and renewal
- Plans. Membership is offered monthly ($9.99/month) or annually ($69/year), or at prices otherwise shown at checkout. Prices may change with notice for future billing periods.
- Payment. Payments are processed by Stripe. We do not store your full card details. By subscribing you authorize recurring charges to your payment method.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled.
- Cancellation. You may cancel anytime from your account page. Cancellation takes effect at the end of the current billing period; you keep access until then. We do not provide partial-period refunds for cancellations except as described below or as required by law.
- Refunds. You may request a refund from your account page. Refunds are granted at our discretion (for example, accidental charges or technical faults). Where required by applicable consumer law, statutory refund rights still apply.
5. Acceptable use
The Service and its memes are provided for your personal, non-commercial enjoyment. You agree not to:
- scrape, crawl, bulk-download, mirror, or resell the Service or its content;
- circumvent the paywall, daily limits, or any access controls;
- share, sublicense, or redistribute member content outside the Service;
- use the Service unlawfully, or to harass, infringe, or harm others.
6. User submissions
If you submit a meme or other content ("Submission"), you represent that you own it or have the right to share it, and that it does not infringe anyone's rights or violate any law. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your Submission in connection with the Service, with credit where provided. We are not obligated to use any Submission, and we may reject, edit, or remove any content at any time for any reason. We remove infringing content per our DMCA / Takedown policy.
7. Intellectual property
Memes are created by their respective authors and remain the property of their owners; we display them with attribution and honor takedown requests. The Service itself (its design, code, branding, and compilation) is owned by us and protected by intellectual-property laws. "Dank Memes Only" and our logos are our marks. Nothing here transfers ownership of others' content to us or to you.
8. Copyright complaints
We respond to notices of alleged copyright infringement under the DMCA. See our DMCA / Takedown policy for how to file a notice or counter-notice. We terminate the accounts of repeat infringers.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. licenses you granted, disclaimers, limitations of liability) will survive.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any meme will meet your sense of humor. Content may be crude or offensive by design; you use it at your own discretion.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Any disputes will be resolved in the courts located in Kanpur, Uttar Pradesh, India, unless applicable law requires otherwise.
